MangoApps ("The Company") grants you a non-exclusive, non-transferable, limited license to use MangoApps Recorder (Free Edition) ("Software") under the terms set forth below. By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software.
- License Grant: The Company grants you a license to use the Software free of charge for personal, non-commercial use only. This license does not allow the Software to be used for any business or commercial activities.
- Restrictions: You may not modify, distribute, sell, or lease the Software. You are prohibited from decompiling, reverse-engineering, disassembling, or otherwise converting the Software to a human-perceivable form. The Software may not be used for any illegal activities, and you must comply with all applicable local, state, national, and international laws.
- Ownership: The Software, including all intellectual property rights therein, is the property of The Company and is protected by copyright and intellectual property laws. This license does not convey any ownership rights to you, and extends to all updates, modifications, and versions unless otherwise specified.
- Disclaimer of Warranty: The Software is provided "AS IS," without warranties of any kind. The Company disclaims all warranties, either express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.
- Limitation of Liability: The Company's liability for any damages caused by the Software or in connection with this EULA, regardless of the form of action, shall not exceed $100 USD. The Company shall not be liable for indirect, special, incidental, consequential, or exemplary damages of any kind.
- Termination: This EULA is effective until terminated. You may terminate it at any time by deleting all copies of the Software. It will also terminate automatically if you fail to comply with any term or condition of this EULA.
- Privacy Policy: Your use of the Software constitutes acceptance of our Privacy Policy, which outlines the data collected and its usage. For detailed information, please refer to our Privacy Policy linked on our website.
- Governing Law: This EULA is governed by the laws of the State of Washington, without regard to conflict of law principles.
- Modifications to this EULA: The Company reserves the right to modify this EULA at any time. Changes will be communicated through updates or notifications on the Company's website. Continued use of the Software after such changes will constitute acceptance of the new terms.
- Support and Maintenance: No support or maintenance is guaranteed for the Free Edition of the Software. Any provided support will be at The Company's discretion.
- Software Updates: The Software may periodically check for updates, and these will be governed by this EULA unless accompanied by a separate license, in which case the terms of that license will prevail.
- Export Control: You agree to comply with all applicable export and re-export control laws and regulations, particularly those where you download or use the Software.
- Indemnification: You agree to indemnify, defend, and hold harmless The Company and its affiliates from any claims, liabilities, expenses, or damages, including legal fees and costs, arising from your use of the Software or your violation of this EULA.
- Dispute Resolution: Any disputes arising out of this EULA will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration will take place in King County, Washington.
